These Terms of Service ("Terms") govern your use of the website www.symbioticdesignacademy.com and any related services (the "Website"), operated by Symbiotic Design Academy, established in Eindhoven, the Netherlands.

In these Terms, "we", "us" and "our" refer to Symbiotic Design Academy. "You" refers to any visitor, registered user, or other person who accesses or uses the Website.

2. Acceptance of these Terms

By accessing or using the Website, creating an account, or submitting a form on the Website, you confirm that you accept these Terms and agree to comply with them. If you do not agree with these Terms, you must not use the Website.

We may update these Terms from time to time, as described in Section 12. Continued use of the Website after an update takes effect constitutes acceptance of the revised Terms.

3. Who can use the Website

The Website is intended for designers, architects, and other professionals, as well as visitors interested in sustainable design education and resources. You must be at least 18 years old to use the Website or create an account. If you are under 18, please do not use the Website or submit any personal data to us.

4. Accounts

Some areas of the Website may require you to create an account. When you do, you agree to provide accurate, current, and complete information; to keep your login credentials confidential and not share your account with others; and to notify us promptly at support@symbioticdesignacademy.com if you suspect unauthorised use of your account.

We may suspend or terminate an account that we reasonably believe is being used in breach of these Terms, is inactive, or was created with false information.

5. Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party. In particular, you agree not to attempt to gain unauthorised access to the Website, our systems, or other users’ accounts; to upload or transmit any material that is unlawful, defamatory, infringing, or that contains viruses or other harmful code; to use any automated system (bot, scraper, or similar) to access the Website in a manner that sends more request messages than a human could reasonably produce, except for standard search engine indexing; to use the contact, support, or any other form on the Website to send unsolicited commercial communications (spam); or to misrepresent your identity or affiliation with any person or entity.

6. Community submissions and content you provide

Certain areas of the Website may allow you to submit messages, comments, or other content ("User Content"), including through the contact form, support form, or community features. You remain the owner of your User Content, but by submitting it you grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display that content solely for the purposes of operating, providing, and improving the Website and responding to you.

You are solely responsible for the User Content you submit and confirm that it does not infringe any third party’s intellectual property, privacy, or other rights, and does not violate any applicable law. We may remove or refuse to publish any User Content at our discretion, in particular where it appears to violate these Terms.

7. Intellectual property

Unless otherwise indicated, all content on the Website — including text, graphics, logos, course materials, the Symbiotic Design Framework and related methodologies, images, and software — is owned by or licensed to Symbiotic Design Academy and is protected by Dutch and international copyright, trademark, and other intellectual property laws.

You may view, download, and print material from the Website for your own personal, non-commercial use, provided you keep all copyright and other proprietary notices intact. You may not otherwise reproduce, distribute, modify, publicly display, or create derivative works from any part of the Website without our prior written consent.

8. Future paid services

The Website may in the future offer courses, downloads, memberships, or other products or services for purchase. At the time of writing, no products are being sold through the Website. If and when paid offerings become available, additional terms specific to those purchases (pricing, delivery, cancellation, and the statutory right of withdrawal under Dutch and EU consumer law) will be published and will supplement these Terms.

9. Third-party links and services

The Website may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms and privacy policy of any third-party site you visit.

10. Disclaimers

The Website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable Dutch law. We do not warrant that the Website will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

Content on the Website is provided for general informational and educational purposes and does not constitute professional advice. You should seek independent professional advice before relying on any information from the Website for a specific project or decision.

11. Limitation of liability

To the fullest extent permitted by Dutch law, Symbiotic Design Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of, or inability to use, the Website.

Nothing in these Terms excludes or limits our liability for damage caused by intent (opzet) or gross negligence (grove schuld), or for any other liability that cannot be excluded or limited under mandatory Dutch law.

12. Changes to these Terms

We may revise these Terms from time to time to reflect changes in our services, technology, or legal requirements. The updated version will be posted on this page with a revised effective date. Material changes will, where feasible, be highlighted on the Website.

13. Termination

We may suspend or terminate your access to the Website, in whole or in part, at any time and without notice, if we reasonably believe you have breached these Terms.

14. Governing law and disputes

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or formation, are governed by the laws of the Netherlands, without regard to its conflict-of-law provisions.

Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the competent court in the district where Symbiotic Design Academy is established, unless mandatory consumer-protection law provides otherwise for individual consumers, who may also bring proceedings in their own country of residence within the EU.
